Nancy Kass' response is helpful in clarifying how she interprets human rights and therefore why she considers ethics a more appropriate framework for choosing between options that appear equally valid from a legal perspective. Human rights are not only relevant to violations, as suggested by Kass, but also provide a positive obligation and an approach for the design, implementation, and evaluation of health programs. This is relevant to governments, as Kass notes, as well as to non-governmental actors. We are in agreement regarding the many benefits to be derived from considering both ethics and human rights in framing public policy options for health.
